Business terms for listed dent repair businesses

These terms apply to any business that claims or adds a listing on losethedent.com, or that receives quote requests through it (a Business, you). They apply in addition to the terms of use and the privacy policy. Lose the Dent (we, us, our) is operated by MCLACHLAN, RICHARD ANDREW (sole trader).
1. Your listing
- Many listings are created by us from public information (your website and your public Google Maps listing). You can take control of your listing to correct it, or ask us to remove it, at any time.
- You confirm that you are authorized to act for the business, and that what you put on the listing (services, service area, prices, warranty, insurance work, certifications) is true and kept up to date.
- Listing a business is free. If we introduce paid features, we will tell you in advance and they will be optional: nothing will be charged without your agreement.
- We may edit, decline, suspend or remove a listing that is inaccurate, misleading, outside the scope of the directory (minor dent, hail, bumper and scratch repair) or in breach of these terms.
2. You are an independent business
You are not our employee, agent, partner or franchisee. You alone are responsible for your quotes, your work, your staff and subcontractors, your taxes, and for holding every license, registration, bond and insurance policy that the law of your state and locality requires for the work you do. We do not check these, and listing you is not a statement by us that you hold them.
3. Quote requests
- We invite a small number of businesses to each request, matched on the services you state, your distance from the driver and your public ratings. We do not promise any number of requests.
- An invitation is open for a limited time (24 hours unless we say otherwise). If you decline or do not respond, another business may be invited.
- Quote honestly from the description and photos: say what method you will use, what is included, and what could change the price once you see the vehicle. Honor your quote unless the vehicle differs from what was described.
- The repair contract is between you and the driver. We are not a party to it.
4. Drivers' information
- Use a driver's information only to quote for, arrange and carry out that driver's repair. Do not add drivers to marketing lists, and do not sell or pass their information to anyone else.
- Before a driver chooses you, communicate through the on-site chat. Do not ask for or send phone numbers, email addresses or links to get around it: the chat blocks them, and repeated attempts can lead to removal.
- Once a driver chooses you, you receive their contact details. You may call or text them about that repair only. You are responsible for complying with the Telephone Consumer Protection Act, the CAN-SPAM Act, do-not-call rules and your state's equivalents when you do.
- Keep drivers' information secure, and delete it when you no longer need it for the repair, your warranty or your legal records.
5. Conduct
Do not post false reviews, pay for reviews, misstate your ratings, disparage other businesses on the Site, or create more than one listing for the same location. Do the work you quoted for, to a professional standard, and deal with complaints promptly.
6. Your content
You give us a non-exclusive, royalty-free license to display your business name, logo, description, prices, photos and quotes on the Site and in the emails the Site sends to drivers. You confirm you have the right to give it.
7. Messages from us
We email you about requests, quotes, chat messages and your listing. These are service messages. Any promotional email we send you will carry an unsubscribe link, and we will honor it within 10 business days.
8. Responsibility
You are responsible for claims that arise from your quotes, your work, your staff or your use of drivers' information, and you agree to cover our reasonable losses and costs if such a claim is brought against us, to the extent the law allows. The disclaimers and limits of liability in the terms of use apply to you.
9. Ending
You can stop using the Site, or ask us to remove your listing and close your account, at any time by emailing hello@losethedent.com. We can suspend or end your access if you break these terms. Requests you have already accepted should still be completed.
10. Changes
We will post changes here with a new date and email account holders about material changes before they take effect.
